RESOLUTION

In supersession  of the Government Resolution contained in Government Notification. No. HM/PR/65/79/12-23 dated 18.12.1979 and the Govt. letter No. HMB. 445/ 85/15. dt 8.4.86 the Govt. of Assam, after careful consideration of all facts and circumstances regarding issuance of State Government advertisement, lay down their Advertisement policy and Rules there of as given below. 


The rules will be effective from the date of Notification.

 

 

ADVERTISEMENT POLICY OF THE GOVERNMENT OF ASSAM

 

                 1)  DEFINITION:

 

i)

‘Government’ means the Government of Assam.

ii)

‘Directorate’ means the Directorate of Information & Public Relations, Government of Assam.
iii)  ‘Advertisements’ means all advertisements issued by the Directorate to Newspapers, journals and other publications but exclude advertisements relating to the State Government undertakings, autonomous bodies etc.
iv) ‘Daily’ means include all newspapers published daily, twice a week or thrice a week.
v) ‘Periodicals’ include publications brought out weekly, fortnightly, monthly, once in two months or quarterly.
vi) ‘Classified advertisement’ means and advertisement to be published  in a compact section of a newspaper under a usual specified head.
vii) ‘Display advertisement’  means and advertisement to be published as a conspicious display of CONTENTS outside specified heads.
viii) ‘List of approved papers’ means the list showing the newspapers, periodicals etc. approved by the Government to receive Government advertisements.

 

         

 

                  2) CLASSIFICATION OF NEWSPAPERS AND PERIODICALS:

 

The newspapers and periodicals for the purpose of issuing Government advertisement will be categorised  as follows :-

           

 

i) Small: Up to 10,000 circulation per issue.
ii) Medium: Between 10,000 & 30,000 circulation.
iii) Big: Above 30,000 circulation.

 

 

                              

 3)   PRODUCTION STANDARD  :

The newspapers and periodicals should have the following minimum print areas respectively to qualify for receiving Government advertisements.

 

     

i) Dailies: Four pages with print area of not less than 45 Cms X  7 Standard columns or equivalent printed space per issue.
ii) Weekly and: 720 CMs. Divided into number of Fortnightlies columns and pages.
iii) Other periodicals: Minimum 32 pages of 1/16Demy or crown size.

 

        

                                                                                                                              

                                                                                           

               4)     ELIGIBILITY FOR RECEIVING GOVERNMENT ADVERTISEMENTS :

 

Newspapers and periodicals will have to fulfill the following requirements to become eligible for receiving Government advertisements.

 

 

    a)   Minimum circulation  :-

 

i) Dailies Minimum paid circulation of 5000 copies.
ii) Weeklies Minimum paid circulation of 1500 copies.
iii) Other periodicals Minimum paid circulation of 900 copies.

 

               

b)   Minimum Issues   :-

 

The newspapers and journals which have brought out minimum number of issues as per the below in the preceding year will be eligible for receiving Government advertisement in a particular year.

 

    

i) Dailies: 325 issues.
ii) weeklies: 44 issues.
iii) Bi-Weeklies: 88 issues.
iv) Monthlies: 10 issues.
v) Bi-Monthlies: 5 issues.
vi) Quarterlies: 4 issues.

 

                

c)   Regularity      :-

 

No newspaper, or periodical will be eligible for receiving Government advertisements before it bring out the following number of issues continuously.

           

i) Dailies: 90 issues.
ii) weeklies: 15 issues.
iii) Bi-Weeklies: 30 issues.
iv) Monthlies: 8 issues.
v) Bi-Monthlies: 5 issues.
vi) Quarterlies: 3 issues.

 

 

 

      d)  Advertisement space :-

 

Newspapers and journals  which do not devote at least 60 percent printed space in every   issue to read and other non-advertisement materials will not be eligible for receiving Government advertisement.

 

           

       e)    Registration with the Registration of Newspaper Essential  for receiving

              Government advertisements.

     

 

                    5)   PROCEDURE FOR INCLUSION IN THE APPROVE LIST:

 

i) The Directorate will prepare a list of newspapers, periodicals etc. approved by the Government for receiving Government advertisements during any particular financial year at the beginning of the year.
   
ii) The publisher of any newspaper or periodical which figures in the list of the preceding year will have to submit to the Director of Information & Public Relations by February 28 that is one month ahead of the next financial year. A certificate from the Chartered Accountants in the prescribed form (in original) claiming paid circulation relating to the preceding calendar year from January to December. 
   
iii) Annual certificates of printing in the prescribed form (in original) indicating average number of copies printed per issue month wise in the preceding calendar year to be obtained from the owner of the press from where the paper is printed will also have to be submitted to this Director of Information and Public Relations by the same date. In case the Editor, Publisher and Printer happen to be the same person, a scrutiny of the certificates will be made by a competent authority approved by the Government if considered necessary.
   

iv)

The Newspapers and journals which figure in the list of newspapers approved for receiving government Advertisements in the preceding year will be considered for any particulars year on submission of the certificates as indicated in para(5) iii) above.

 

       

      

     

                 6)  APPLICATION FOR FRESH PUBLICATION :

a)

Applications from fresh publication are to be submitted by the publishers concerned in the prescribed  Performa to the Director of Information & Public Relations affixing Court fee Stamp of Rs. 8.25 thereon together with certificates as indicated in papa 5 (ii) relating to the period since the launching of the publication or the preceding calendar year.

b) The Director of Information & Public Relations will after scrutiny, refer the application with necessary papers, if it fulfils all the required conditions to the Government for consideration for approval towards receiving Government advertisements.

The Director of Information and Public Relations will scrutinizes the applications and the certificates received on or before February 28 and will finalize and publish in March every year the list of approved papers for receiving Govt. advertisements during the next financial year. No application or certificate received after February 28 will be considered.

                

                     8)  HOUSE MAGAZINES, SOUVENIRS ETC.:

 

i) House Magazine will not be eligible for receiving Government advertisements.
ii)

Advertisements would normally not be issued to souvenirs except those published by

Assam Sahitya Sabha and Assam Science Society.

 

Request for advertisement  in any other souvenirs will be decided with the approval of the Secretary of the Department. No clearance from the Home (Publicity) Department

will be Necessary.

     

                      

 

                                    POLICY FOR RELEASE OF ADVERTISEMENT :

 

                  9) GENERAL POLICY:

 

a)

Advertisement are not intended to be a  measure of financial assistance and no

newspaper can claim advertisement as a matter of right.

 

 

           The primary objective behind releasing Government advertisements is to secure the

           widest possible coverage keeping in view of the special needs and the targeted

           audience of the message contained in the advertisement. In pursuance of the     

           broaden social objective of the Government, weightage as far as possible will

           however be given to :-

 

i) Small and Medium newspapers.
ii) Language papers.
iii) Papers in backward areas.
iv) District papers.

 

 

b)

The general policy which govern the release of advertisement within the fund

 available will be as  follows  :-

    

i) There must be widest possible coverage.
ii)  

Pulling power of the papers in the areas intended to be covered will be considered.

 

iii) Political affiliation of a newspaper will not be taken into account but one that does not show regards to journalistic ethics will not be issued advertisements. The paper’s non-adherence to the ethies will be judged by any of the following tests.

 

 

1) Reports imputes to a person statements he or she did not make.
2) Baseless, motivated, malicious, scurrilous or absence reports.
3) preaching violence or lawlessness.
4) Reports repugnant to socially accepted conventions of public decency and orals.
5) Non-publication or publication in mutilated or tendentious manner of Government press notes, handouts, and communiqués.

 

                                 

 

 

c)

Classified advertisements will not normally be issued to papers with periodicity of more than a  week.

   
d)   Release of Advertisements:-

                 

 All Government Advertisements and advertisements of State undertaking and other will be routed through the Director  of Information  & Public Relations, Government of Assam. He will act as agency on behalf of the Government of Assam. In the Home (Information and Public Relations) Department  to release the advertisements to the different newspaper and periodicals. Payment of the  bills will be made by the different advertisement Departments of the Government of State undertakings and other concerned after getting the clearance of the Director of Information and Public Relations, Government of Assam. No treasury should honour and pay advertisement bills unless it is cleared by the Director of Information and Public Relations, Assam

 

                 

e)

The advertising Department should not issue more than two corrigendum relating to

any particular advertisement.

 

f)

The Director of Information and Public Relations will arrange release of advertisement both classified and display to the newspapers and periodicals  in the approved list, as deemed proper for effective coverage. Bill of the Govt. Undertakings and those relating to commercial and display advertisements of the Government Departments will be transmitted to them for payment duly.

 

g)

In case of wrong publication or printing mistake, the newspaper will republish the

advertisement in the very next issue free of cost.

       

                  10)  RATES:

 

a)

        Advertisement rates for each paper included in the list of approve papers will be fixed

        by the Director of Information and Public Relations and he will be after the rates to the paper in the form of an annual rate contract along with other terms and conditions as may be formulated by the Director of Information & Public Relations within the policy frame of the Government. Rates so fixed will be valid for the whole year.

 

b)

There will be no revision of rates during the financial year and Violation of the annual rate contract by any paper will lead to removal of the paper from the approved list. Rates will be fixed taking into consideration the circulation the paling power, size, area covered etc.

 

c)

Appeal against Director of Information and Public Relations decision may be preferred to the Secretary, Home Department within a period of one month from the date of communication of  such a decision. Such appeal will be heard by the Secretary and his decision will be final.

 

  Notwithstanding any thing contained in a these Rule, the State Government may

  at any time call for records in any matter relating to issue of Government

  advertisements and give such orders as the Government may deem fit. The

  Govt.’s decision is this regard shall be final.

 

d)

The papers and periodicals may have their own rates of advertisements but Government will take use of only such papers and periodicals whose rates are acceptable keeping  in view on the publicity requirements.

 

                                    

 

                     11) Removal from Approved list:-

 

                          The name of the newspaper may be removed from the list of approved papers at  any time if :-

 

i)

 it is irregular in publication.

ii)

 it does not maintain the production standard as outlined in para. (3).

iii)

 it does not observed journalistic copies or indulges in any activity  referredtoin para 9 (B)& (C).

NOTIFICATION

 

                                                                                    Dated Dispur, the 24 th April, 1992.

                                                                                  

            

 

No. HMB. 141/87/39. The Governor of Assam, after careful consideration of all facts and circumstances regarding issuance of State Govt.‘s  advertisements and payments of advertisement bills is pleased to amend Rules No. 9 (D)  and 9 (F) of the Advertisement Policy of the Government of Assam issued under Government resolution No.HMB.445/84/23 dated 21.8.86 and to substitute the same as follows :

 

9 (D) : Release of Advertisement : (a) All classified and display advertisement will be issued by only one agency . i.e. Director of Information and Public Relations who has the necessary expertise. All Government Departments and Public Undertakings will send their both classified and display advertisements to the Director of Information and Public Relations and in no case Government Department and Public Undertaking will issue advertisements directly to newspapers / periodicals .

 

            (b) Payment of advertisement bills will be made by the Director of Information and Public Relations. Necessary funds are to be placed in the annual fund of the Directorate of Information and Public Relations.

 

9(F) : All other display advertisements not covered under these rules will also be issued by the Director of Information and Public Relations and Payment on account there of made centrally. For this purpose and also for the purpose envisaged under 9 (D)  (b) above, funds earmarked in the budgets of different heads of different heads of Government Departments may be diverted to the budget of Director of Information and Public Relations.

           

 

This will be effective from the date of this notification.
